These Terms of Service ("Terms") govern your use of Review Mammoth, a service provided by INDUSTRY MAMMOTH LLC ("we," "our," or "us"). By using our Services, you agree to these Terms.

1. Services Provided

Review Mammoth offers automated review management solutions, including:

  • Sending review requests via SMS and email.
  • Review monitoring and analytics.
  • Integration with online platforms.

We do not guarantee a specific number of reviews or control customer responses. Our Services require cooperation from the user to be effective.

2. Account Registration & Responsibilities

  • You must provide accurate and complete information when registering an account.
  • You are responsible for maintaining the confidentiality of your account login details.
  • You must promptly update any account information to keep it accurate and complete.

3. Payment Terms & Subscription Requirements

  • Services are billed on a subscription basis and require payment as specified at signup.
  • Payments are non-refundable unless otherwise stated.
  • Failure to make timely payments may result in suspension or termination of your account.
  • If you purchase a website design and development service, the ownership covers only the agreed-upon design and content. However, a monthly hosting fee is required to maintain the website on our servers.
  • If hosting fees are not paid, we reserve the right to suspend hosting services, rendering the website inactive until all outstanding payments are made, including any applicable reactivation charges.

4. Acceptable Use

By using our Services, you agree to:

  • Use them only for lawful purposes.
  • Not use them to send unsolicited or spam messages.
  • Not engage in conduct that disrupts the Services or violates any applicable laws.
  • You must ensure that all contact data you upload or provide has been collected lawfully and includes appropriate consent for communication via SMS or email.

We reserve the right to suspend or terminate accounts that violate this policy.

5. Customer Data Usage

We respect your privacy and the confidentiality of your customer data.

  • Your customer list will only be used for requesting reviews.
  • Your customer list will not be disclosed, transferred, or used for any other purpose outside of message delivery via our service providers or aggregators.
  • We do not sell or share customer data for marketing purposes.
  • We implement security measures to protect customer data from unauthorized access or misuse.

You are responsible for ensuring that your use of customer data complies with applicable privacy laws.

By providing us with customer contact information (such as phone numbers and emails), you confirm that you have obtained the necessary consent from those individuals to receive review requests via SMS or email on your behalf. You acknowledge that it is your sole responsibility to ensure this consent is valid, compliant with applicable laws, and clearly authorizes communication for review solicitation purposes.

6. Intellectual Property Rights

  • All content, software, and materials provided through our Services—including text, graphics, logos, and software—are the property of INDUSTRY MAMMOTH LLC or its licensors.
  • You may not copy, distribute, or use any materials from our Services without prior written consent.

7. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without any express or implied warranties.

  • We do not guarantee that our Services will be uninterrupted or error-free.
  • We are not responsible for changes in the policies or performance of platforms we integrate with, such as Google, Yelp, or Facebook.

8. Limitation of Liability

To the fullest extent permitted by law, INDUSTRY MAMMOTH LLC is not liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of profits or business opportunities.

Our total liability is limited to the amount you paid for our Services in the 12 months preceding the claim.

9. Termination & Service Suspension

We may terminate or suspend your account under the following circumstances:

  • Non-payment of subscription fees.
  • Violation of these Terms.
  • Abuse or misuse of our Services.

Upon termination:

  • You will lose access to our Services.
  • Any outstanding payments remain due.

10. Refund & Cancellation Policy

  • You may cancel your subscription at any time via your account dashboard or by contacting us.
  • Upon cancellation, your access remains active until the end of the billing cycle, after which no further charges will apply.
  • Refunds are only offered within the first 30 days of your subscription. Requests must be submitted in writing. After 30 days, no refunds will be issued.

11. Governing Law

These Terms are governed by the laws of California. Any disputes will be resolved in California courts.

12. Changes to These Terms

We may update these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our Services constitutes acceptance of the updated Terms.
